A California Lottery account on Californialottery.com or mobile application offers players located in California the ability to purchase and play select lottery games on their personal computers, mobile devices, and electronic devices. Use of these services is governed by these terms and conditions. Please review them carefully.
Definitions. As used herein, “these terms” refers to these Online Purchase Terms and Conditions; “services” refers collectively to Californialottery.com, California Lottery mobile applications, and all services, functions, and features described in these terms; “online” refers to use of the internet or any other means to access the services; “account” refers to a California Lottery account registered on the services; “we,” “us,” and “our” refer to the California Lottery, its agents, contractors, sub-contractors, and third parties involved in producing or delivering the services; and “you” or “your” refers to you, the user.
Acceptance of Terms. By applying for and using an account or the services, you accept and agree to be legally bound by all of these terms. If you do not accept and agree to be bound by any of these terms, you should not apply for an account and are not authorized to use the services.
Terms Subject to Change. We may change these terms at any time and without notice. All changes are effective upon posting. Your continued use of an account or the services after changes are posted constitutes your acceptance of those changes. It is your responsibility to review these terms periodically for changes.
Additional Terms. Additional terms and conditions may apply to your use of an account and the services, such as the Terms of Use and Privacy Policy. It is your responsibility to review any other applicable terms, conditions, and policies.
Violation of Terms. We may take any lawful action we deem appropriate in response to an actual or suspected violation of these terms. This includes, but is not limited to: suspending or terminating your account; blocking access to the services; withholding your withdrawal of any funds pending completion of an investigation; invalidating a purchase; denying award of a prize or reclaiming a prize that has been awarded; reporting and providing information about your actions to any third party, including law enforcement; cooperating in any investigation; and initiating or participating in any civil or criminal action. By violating these terms, you waive and forfeit any claim to a prize or any portion of a prize.
General Requirements. To deposit funds and/or purchase a lottery ticket online, you must: be at least 18 years of age; have an account; have sufficient funds in your account to make the purchase; be physically located in California at the time of initiating a deposit or purchase; and be in compliance with all federal, state, and local laws, these terms, and California Lottery directives, rules, and regulations. You agree not to use or attempt to use the services in any way that:
If we suspect that you are engaging in any fraudulent, unlawful, or improper use of the services, including, but not limited to, identity theft, fraud, or money laundering, we may immediately suspend your account, including your ability to withdraw any funds, and report your activities to any third party, including law enforcement. We are not liable for any damages or losses resulting from our response to suspected unlawful activity.
Limited License and Use. You are granted a limited license to use the services for its intended purpose only and in accordance with these terms. We may revoke this limited license at any time. Your use of an account or the services does not create any agency, partnership, trust arrangement, fiduciary relationship, joint enterprise, or other relationship between you and us.
Intellectual Property. We own all intellectual property appearing on the services, including, but not limited to, all copyrights, trademarks, service marks, and trade dress. We own the rights to all content appearing on the services, which includes, but is not limited to, images, pictures, graphics, photographs, animations, videos, music, audio, text, games, game mechanics, play methods, code, software, format, presentation, and organization. Your use of the services confers no ownership rights or license to use any intellectual property or other content beyond the limited license for use granted in these terms. Unless you have our express written consent, you agree not to:
You are liable for any damages, costs, or expenses arising out of or in connection with your commission of any of the above. If you become aware of any third party committing any of the above, you agree to immediately notify us and to cooperate in any resulting investigation.
Change in services. We reserve the right to add, remove, modify, suspend, or terminate the services or any aspect of the services at any time and without notice. We are not liable for any damages or losses resulting from any such changes.
Applying for an Account. To apply for an account, you must provide all information requested on the registration form. This specifically includes, but is not limited to, your full legal name, address, date of birth, and last 4 digits of your social security number. By submitting your application for an account, you represent and warrant that:
We may require you to provide additional information, provide copies of documents, or appear in person at a designated claim center. We may require you to change or update account information at any time, including, but not limited to, your username and password. We do not guarantee that an application will be approved or that an account will be registered in any specific period of time. We do not guarantee that an update to any account, including username and password, will be completed in any specific period of time. You are strictly prohibited from opening more than one account. We reserve the right to take whatever lawful actions we deem appropriate if we suspect you have more than one open account. We are not liable for any damages or losses resulting from the registration of an account, update of an account, request for additional information, suspension of an account pending investigation, or deactivation of an account or accounts for any reason.
Age & Identification Verification. By submitting your application for an account, you consent to our use of any age-verification and identity-verification technology or method we deem appropriate. You may be required to show additional evidence of your age and identification, provide copies of documents, or appear in person at a designated claim center. We do not guarantee that our age-verification and identity-verification technology and methods will be able to locate records for every person. Your application for an account will be denied if your age and identity cannot be verified. We are not liable for any damages or losses resulting from denial of your application, requesting that you provide additional information, or requesting you appear at a claim center.
Application Denials. You understand and agree that an account is a discretionary privilege and that we reserve the right to reject an application for any reason. We are under no obligation to explain the reason for delay in processing or denial of an application. We are not liable for any damages or losses resulting from any delay in processing or denial of your application.
Transaction History. You understand and agree that we may record and store any transactions you conduct through the services. A transaction history is also available for you to view through your account. This history is provided as a convenience only. It is not an official record. Information appearing in the transaction history does not constitute or establish a transaction, winning ticket, or prize. We do not guarantee the accuracy of information appearing in your account transaction history. It is your responsibility to notify us of any errors in your transaction history. We are not liable for any damages or losses resulting from your reliance on or failure to report errors in your transaction history.
Balance Errors. In the event that any funds are mistakenly credited to or deducted from your account, we are entitled to make the appropriate adjustments. You must notify us immediately if any funds are incorrectly credited to or deducted from your account. If you withdraw any funds incorrectly credited to your account, we may withhold that amount from any deposit or prize, or otherwise seek recovery. If you use any funds incorrectly credited to your account to purchase a lottery ticket, we may deem the purchase void and refuse to pay any prize or recover any prize already paid.
No Interest on Funds. You will not receive any interest of any kind on funds deposited or held in your account, including any claimed or unclaimed prizes. It is your responsibility to only deposit what you intend to use and to claim and withdraw prizes in a timely manner. You will also not receive any interest of any kind on any delayed or disputed deposit, credit, or prize award to your account. We are not liable for any damages or losses resulting from any delay in a deposit, credit, or prize award.
Suspension & Termination. You understand and agree that an account is a discretionary privilege that we may suspend or terminate at any time, for any reason, and without notice. In the event of termination, any funds in your account will be returned unless subject to withholding under these terms or any state or federal law. It is your responsibility to provide accurate account information so that we may contact you if necessary. If necessary, we may require that you appear in person at a claim center to claim any account balance or prize. We are not liable for any damages or losses resulting from our inability to contact or locate you.
Responsible Gaming Exclusions. You may temporarily or permanently exclude yourself from using your account through our responsible-gaming tools or by contacting the Customer Support Center through live chat or calling 1-844-887-6836. During an exclusion, you will not be able to log into your account and will not be able to purchase lottery tickets, participate in second-chance games, or other account activities. You understand and agree that we may temporarily or permanently restrict access to your account if we deem it necessary to promote responsible gaming. An exclusion cannot be reversed, and you cannot open more than one account. Any breach of an exclusion will result in forfeit of all winnings. After an exclusion period ends, you will be required to manually reactivate your account and your deposit limit may be reduced. During an exclusion, we will not directly send any marketing material to you. We are not liable for any damages or losses resulting from an exclusion or inability to access your account during an exclusion.
Inactive Accounts. If you do not sign-in to your account for 36 consecutive months, we may close your account as inactive and transfer any funds therein, minus any amount owed to us, to the California Department of Treasury in accordance with applicable unclaimed-property laws. It is your responsibility to close your account in a timely manner. We are not liable for any damages or losses resulting from inactivity fees, closure of your account, or transfer of funds to the Department of Treasury.
Closing Your Account. You may close your account at any time. We may require you to provide certain information to verify your identity before closing your account. You are responsible for payment of any outstanding balance owed on your account. We do not guarantee a specific time by which your account will be closed. Records relating to your account may be maintained after your account is closed for a variety of reasons such as tax reporting, balancing, investigations, and record keeping. Closing your account does not mean that all records of your account or account history are purged from the account.
Depositing Funds. You may deposit funds into your account using any method that we have approved. By initiating a deposit, you represent and warrant that you:
We are not required to examine your authority to use a payment source or method and are entitled to assume you have authority. We may require you to provide additional information, provide copies of documents, or appear in person at a designated claim center. Making a deposit without authority to use the payment source or method may invalidate any purchase made and any prize won. We do not guarantee that a deposit will be processed and made available in any specific period of time. We do not guarantee that a deposit will be free from error. We reserve the right to deny any deposit at any time and without notice. We are not liable for any damages or losses resulting from any delay, denial, or error in processing a deposit.
Third-Party Transaction Fees and Penalties. You agree to abide by all applicable terms and conditions required by your financial institution or payment processor. You are solely responsible for any transaction fees or penalties of any kind imposed by any financial institution, payment processor, or other third party associated with processing your transaction. You are required to reimburse us for any losses we suffer as a result of any transaction fees or penalties of any kind associated with your transaction. You hereby authorize us to hold and collect any amount owed to us as a result of any such fees or penalties from your deposits or winnings. We reserve the right to pursue any other means to recover such losses.
No Withdrawal or Transfer of Deposits. Unless required by law, funds you deposit into your account cannot be withdrawn, returned, charged-back, re-credited, or transferred to another account. It is your responsibility to refrain from depositing more than you intend to use. You agree that you will not attempt to deny, reverse, charge-back, re-credit, block or otherwise attempt to invalidate, recover, or deny us receipt of a deposit. You hereby authorize us to hold and collect any amount owed to us as a result of any such fees or penalties from your deposits or winnings. We reserve the right to pursue any other means to recover such losses.
Minimum & Maximum Deposits. We reserve the right to set or change a minimum required and/or maximum allowed deposit amount at any time and without notice. We are not liable for any damages or losses resulting from setting or changing any minimum or maximum deposit amount.
General Conditions. Various promotions may be offered from time to time. These offers are subject to additional terms and conditions specific to the promotion. By accepting the offer, you agree to all such additional terms and conditions. Unless expressly stated otherwise, promotional offers expire within 24 hours after being issued, have no cash value, and cannot be exchanged for money. Promotional offers are discretionary, and you have no right to receive or redeem any specific offer. Promotional offers may be canceled at any time and without notice. Information about promotional offers in your account overrides any inconsistent information you receive through notification. We are not liable for any damages or losses resulting from any delay, error, or failure to make or accept any promotional offer.
Multiple Offers. Pending offers available for you to claim will be listed in your account, along with corresponding requirements. You can only claim one offer at a time. Offers will be available to claim in the order they are received. You may change the order in which offers will be claimed in your account or by calling the Customer Support Center at1-844-887-6836. We do not guarantee that promotional offers will be made in any specific order or that changes will be made in a specific period of time. We are not liable for any damages or losses related to the receipt or failure to receive a promotional offer, the order in which offers are received, delay or inability to change the order in which offers are claimed.
Daily Spin to Win. Account holders may have the opportunity to play the interactive Spin to Win game each day that they log into their California Lottery account for a chance to win online entries into a drawing or other prizes. To participate in this promotion, a person must have a properly registered, active account. You are limited to one play per day. Each play must take place between 12:00:00am ET and 11:59:59pm ET. We are not liable for any damages or losses resulting from the availability of Spin to Win, cancelation of this promotion, or other delay or inability to participate in this free promotion.
Promotional Awards. Unless expressly stated otherwise, any game, credit, entry, or other promotional award has no cash value, cannot be exchanged for money or other promotional awards, and may be expired or rescinded at any time without notice. Unless expressly stated otherwise, any free game or play awarded through a promotion must be used within 24 hours or award or will expire worthless. Unlike promotional games, cash prizes won from playing promotional games do not expire. To withdraw a cash prize, you must have a properly registered account, a properly registered payment method, and have previously completed a deposit into your account. We are not liable for any damages or losses resulting from the expiration or rescission of a promotional award for any reason.
Location Requirement. You must be physically located in California to deposit funds into your account, make purchases, and use some other features. Any deposit of funds, initiation of a purchase, or attempt to deposit funds or initiate a purchase through the services while physically located outside of California is strictly prohibited and may violate state or federal law. You understand and agree that initiating any ticket purchase while physically located outside of California is void and that you waive any claim to a prize or any portion of a prize you may have won. If it is determined that you initiated a purchase through the services while located outside of California, we reserve the right to deem your deposit invalid, purchase invalid, refuse to award a prize, reclaim a prize that has been awarded, terminate your account and refer the matter to law enforcement where applicable.
Geo-Location Technology. We use a variety of geo-location technology and methods to verify your location. Any use of software or other methods intended to provide a false location is prohibited, invalidates your purchase, and may violate state or federal law. We do not guarantee that our geo-location technology will verify the location of every person or device. If we are unable to verify that you are physically located within California, your access will be blocked and you are prohibited from making deposits or initiating purchases through the services. In the event that you are not located in California and geo-location technology fails to block your access, you are hereby notified that making a deposit or initiating a purchase may violate state or federal law and it is your responsibility to refrain from doing so. We are not liable for any damages or losses resulting from any failure of geo-location technology or your inability to access the services.
Location Check. By registering for and using an account or the services, you consent to have your location verified by our geo-location technology. Our location check is automatically activated any time you attempt to log into your account and use the services. Your location will not be checked after you leave the services.
Location Privacy. Your privacy is extremely important to us. Information relating to your location and/or the location of your mobile device may be shared with our contractors, sub-contractors, affiliates, and other third parties for a variety of reasons including but not limited to, providing the product, service, or transaction you requested, legal purposes, and marketing purposes. A record confirming your location may be retained for at least 14 months.
Purchases. Initiating any purchase through the services constitutes your consent to deduct the cost of that purchase from your account or selected payment method. Where purchases are made through the account, the purchase will be deducted first from your deposit balance and then, if the deposit balance is insufficient, from any unwithdrawn prizes in your account. We do not guarantee the timeliness of any purchase and reserve the right to refuse any attempted purchase for any reason. We are not liable for any damages or losses resulting from any delay in or denial of processing a purchase.
All Sales Are Final. All sales are final and purchases made in error will not be refunded. You are solely responsible for ensuring that you have selected the correct lottery game and all options relating to that game, including, but not limited to, ticket, number of tickets, price of ticket/s, and numbers played on a ticket or tickets. We are not liable for any damages or losses resulting from any error you make in selecting your purchase
Games Offered. We do not guarantee that any specific California Lottery game will be offered through the services. We may limit purchases of any game, ticket, or wager on a particular set of numbers at any time and without notice. We may terminate a game at any time and without notice. We are not liable for any damages or losses resulting from any purchase limitations or game termination.
Subscriptions. We may offer the ability to initiate recurring purchases of tickets for upcoming drawings. These automatically recurring purchases, called subscriptions, may be initiated and canceled at any time through your account or by contacting the Customer Support Center. When you initiate a subscription for a game, one ticket will be purchased for each drawing held for that game over the following two weeks. Thereafter, unless canceled, you will automatically purchase one ticket for each drawing of that game on a recurring weekly basis. Any purchase completed prior to cancelation cannot be refunded. It is your responsibility to cancel your subscription before an unwanted purchase is completed. You can view the date and cost of upcoming purchases in the subscriptions section of your account. Subscriptions require use of an approved payment method. We may cancel your subscription without notice at any time and for any reason, including, but not limited to: your account is closed or suspended, you are excluded from play through responsible-gaming tools, your payment method is declined, you violate these terms, or your account is inactive for six months. We do not guarantee that subscriptions will continue without interruption or cancelation and it is your responsibility to confirm a subscription is still active. We are not liable for any damages or losses resulting from the failure to initiate or from the cancelation of your subscription.
Game Disputes. All purchases, tickets, transactions, offers, and claims are subject to California Lottery rules, directives, state and federal laws, and any prospective changes thereto. Printouts, photographs, screenshots, and other images are not, and will not, be accepted as, evidence of a ticket, purchase, transaction, or outcome. The only evidence of a ticket, purchase, transaction, or outcome is the data contained in our system that passes all security tests, including, but not limited to, verification against third-party systems and transaction history. In questions involving ticket validation, our determination is final. In cases of dispute for any reason, we may at our sole discretion, replace the disputed ticket with an unplayed ticket of equal value or refund the purchase price. You understand and agree that replacement with an unplayed ticket or refund of the purchase price is the sole and exclusive remedy for any dispute over a ticket’s validity or outcome.
General. Subject to these terms, and all applicable rules, directives, policies, and state and federal laws, prizes won through the services may be claimed as follows:
Before payment of any prize, we may require you to provide additional information, provide copies of documents, or appear in person at a designated claim center. We may change available methods for claiming a prize at any time and without notice. If we suspect any unlawful conduct or violation of these terms, we may withhold payment of a prize pending completion of an investigation. You agree to cooperate with us in any investigation. We do not guarantee payment of a prize within any specific period of time. You will also not receive any interest of any kind on any delayed or disputed prize award. We are not liable for any damages or losses resulting from any delay in a deposit, credit, or prize award.
Online Claim Form. You may be required to complete an online claim form to claim a prize over $600 and up to and including $99,999.99. By checking the boxes on this form, you represent and warrant that: you are the registered user of the account, your account information is accurate, and you accept our claim policy. You further certify that you are a U.S. person, have provided us with your correct social security number, are not subject to backup withholding, and are not subject to the Foreign Account Tax Compliance Act (FATCA). You understand and agree that checking these boxes constitutes your electronic signature.
Backup Withholding. Backup withholding refers to the process by which a person or entity making payments to you must, under certain conditions, withhold and pay a percentage of such payments to the IRS. Your prize will be subject to backup withholding if you do not provide your correct social security number to us, you do not certify your social security number when required, the IRS notifies us that you furnished an incorrect social security number, the IRS notifies you that you are subject to backup withholding because you did not report all of your interest and dividends on your tax return, or you do not certify to us that you are not subject to backup withholding.
Foreign Account Tax Compliance Act (FATCA). The FATCA requires U.S. taxpayers to report certain foreign financial accounts and offshore assets. It also requires certain foreign financial institutions to report all U.S. account holders that are specified U.S. persons. It is your responsibility to determine if you own foreign financial assets subject to the FATCA or if you qualify for an exemption from the FATCA. Withholding is the cost of not reporting.
Claiming in Person. If you are required to claim a prize in person at a designated claim center, you will be required to provide us with a valid government issued picture identification and proof of your social security number. We may deposit a prize won through the services into your account even if the prize was claimed in person. To verify you are presenting acceptable identifications please call the Customer Support Center at 1-844-887-6836.
Tax Obligations. A lottery prize is considered income and a taxable event when claimed or received. We report all prizes over $600 to the IRS and California Department of Treasury. A Form W-2G is generated for all prizes over $600 and made available to you through your account. We are required to withhold state and federal tax from all prizes over $5,000. These withholdings are estimates only and do not necessarily satisfy the tax liability. It is your responsibility to immediately inform us if you believe there is an error in reporting or withholding. You are solely responsible for properly reporting and paying your applicable local, state, and federal taxes. We are not liable for any damages or losses resulting from your failure to properly report or pay any local, state, or federal taxes.
State Debt Check. Before paying any prize of $1,000 or more, state law requires us to check for certain debts such as liabilities to the state, support arrearages, unemployment benefit restitution, and delinquent accounts due to a court. If any such debts exist, we are required to offset your prize by the amount of the debt. If you believe that prize money was withheld for a debt that has already been paid, it is your responsibility to contact the agency reporting the debt and seek reimbursement. We are not liable for any damages or losses resulting from any offset from a prize for payment of a debt.
Claim Errors. A lottery claim may not be premised on human or electronic error in the communication, display, or transmission of data regardless of how that data is recorded, displayed, or transmitted. A claim may not be premised on any intentional human, electronic, or other form of communication or transmission that was not authorized by the California Lottery. We are not liable for any damages or losses resulting from any erroneous or unauthorized communication, display, or transmission of data.
Failure to Claim a Prize. A prize must be claimed within one year of the date that it was won. Any prize that is not claimed within 1 year will be deemed unclaimed and deposited into the school aid fund in accordance with state law. It is your responsibility to properly claim your prize within 1 year. We are not liable for any damages or losses resulting from your failure to properly claim your prize.
Prize Withdrawals Only. You may withdraw prizes in your account. You may not withdraw deposits that you have made into your account unless required by law. It is your sole responsibility to not deposit more than you intend to use.
Withdraw Methods. Prizes may be withdrawn by bank transfer, bank draft, or other method we approve. You may initiate a withdrawal online through your account or by calling the Customer Support Center at 1-844-887-6836. By initiating a withdrawal, you consent to our: deducting the withdrawal amount from your account; retaining any amount owed to us under these terms; and sharing your personal information with any third parties we use to process your request. We are not required to use any specific method, bank, or payment processor that you identify. You cannot make any withdrawal, including any prize amount, until you have successfully completed at least one verified deposit. We do not guarantee that withdrawals will be processed in any specific period of time. We are not liable for any damages or losses resulting from delay in processing a withdrawal.
Additional Documentation. Before processing a withdrawal, we may require you to provide additional information, provide copies of documents, or appear in person at a designated claim center. You may also be required to complete additional claim forms and/or certify documentation detailing your deposits, withdrawals, and other account transactions.
Investigative Holds. You understand and agree that we may hold any withdrawal if we suspect that you may be engaging in or have engaged in fraudulent, collusive, unlawful, or improper activity pending completion of an investigation. You agree to cooperate with us in any investigation into such activity. You understand and agree that your refusal to cooperate with an investigation may lead to a hold being placed on your withdrawal. We are not liable for any damages or losses resulting from any delay or denial of a withdrawal resulting from an investigation.
Privacy & Security. We take your privacy seriously and will diligently endeavor to keep your personal information confidential. We will only share personal information about you with others: in accordance with these terms and our Privacy Policy; to perform a transaction you have requested; if we have your consent; if we need to protect our rights or property; or if authorized or required to do so by law. Security measures have been integrated into the design, implementation, and day-to-day operations of the services as part of our continuing commitment to the security of electronic content. We do not, however, guarantee that any communication or information will be secure or free from unauthorized access by third parties. Your use of the services is at your own risk. We are not liable for any damages or losses resulting from a security breach except as required by law. A copy of our Privacy Policy is available on the services.
Winner Information. If you win a prize of $10,000 or less, you understand and agree that we may use your first name, last initial, city, and prize amount for promotional, advertising, and/or publicity purposes. You understand and agree that we may freely use, reproduce, and display this information, in whole or in part, alone or together with other information, through any and all forms of media, in any manner, anywhere, in perpetuity, and without restriction, reservation, or limitation.
Communications from Us. We may use your account information to contact you by direct mail, email, text message, and/or telephone regarding use of your account and transactions. You may also opt-in to receive promotional material and newsletters. You may unsubscribe to these services by following the instructions contained in the emails or text messages.
Disruptions. Access to the services, or your account may be unavailable, delayed, limited, or slowed by various disruptions. We do not guarantee that the services, or your account will be uninterrupted, free from delay, or continuously available. We are not liable for any damages or losses resulting from any disruption, delay, or unavailability of the services, or your account.
Disclaimer of Warranties. The services and your account are offered on an “as is” basis. We make no warranties of any kind, implied or express, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose, or non-infringement. Use of the internet carries inherent risks and dangers. We do not guarantee that the services or your account are free from these inherent dangers, including, but not limited to, viruses, spyware, malware, or other invasive, malicious, or damaging software, code, or applications of any kind. Nor do we guarantee that use of the services or your account will not cause damage or loss of any kind. We are not liable for any damages or losses of any kind resulting from your use of the services or your account, or for any actions by third parties.
Unauthorized Use. We are not liable for any damages or losses resulting from a third party’s unlawful or unauthorized use of your account. We are not liable for any damages or losses resulting from a third party’s unlawful or unauthorized use of any payment source or method, including, but not limited to, credit and debit cards, regardless of whether the payment method is under investigation or whether any card has been reported stolen. It is your responsibility to keep your username, password, and other account information confidential. If your username and password have been entered correctly, we are entitled to assume that you are the person using your account. You are responsible for any charges, costs, expenses, damages, liabilities, and losses of any kind that you, we, or any third party may incur as a result of your failure to keep your account information confidential. It is your responsibility to immediately notify us if you suspect or discover that your account has been compromised. You agree to cooperate with any investigation into unauthorized access of your account.
Limitation of Liability. Indemnification. Severability. If any provision of these terms is deemed unlawful or unenforceable for any reason, that provision will be severed from these terms and the remaining provisions remain in full force.
Governing Law. All transactions and claims covered by these terms are subject to the laws of the State of California, the rules, regulations, and directives of the California Lottery, and any subsequent changes. You understand and agree that any dispute arising out of your use of the services or your account is governed by the laws of California. You further understand and agree that federal and state courts within California have exclusive jurisdiction over any claims arising out of your use of the services or your account.
